AB 1826: Mandatory Commercial Organics Recycling

Background

Assembly Bill 1826 (AB 1826) was signed by Governor Brown in 2014 and requires businesses to recycle organic waste if their total waste generation reaches a specific threshold. For this purpose, organic waste means food waste, green waste, landscape and pruning waste, nonhazardous wood waste, and food-soiled paper waste that is mixed in with food waste.

As of September 2020, any commercial business or multifamily dwelling (MFD) that generates 2 or more cubic yards of solid waste per week is required to participate in an organic waste recycling program. While MFDs are included under this law, their organic waste recycling programs are not required to include food waste.
